Harbor Island in Court Next Week (In Court On Oct 14)
By Ed Moser
The city of Alameda’s lawsuit against the owners of the Harbor Island apartments will be brought before a federal judge next Thursday in San Francisco, to decide the fate of some 150 residents still living at the complex.
The city is asking for a temporary restraining order to prevent a mass eviction of tenants at the West End apartments, which is scheduled to take place Nov. 3. City Attorney Carol Korade said the court gave this case an early hearing because of the Nov. 4 deadline.
“(The court) recognized the serious risk and urgent need to get this case heard,” Korade said. “The federal court expedited their calendar and made this a top priority.” Korade said cases aren’t typically heard so fast. “I’m amazed how fast they’ve been,” she said.
This type of lawsuit against a landlord has never been argued in front of a judge, Korade said.
The suit alleges that the evictions constitute an unfair business practice. The suit says, “150 of Alameda’s most vulnerable families face homelessness after years of paying excessive rents for substandard housing.”

I am a former tenant of Harbor Island Apartments and I know that our eviction is a clear case of gentrification, which is not illegal but immoral.I lived in Alameda for over nine years and developed strong ties to the West End community, and my children prospered in the schools. I read former councilmember Kerr's comments and she has been blessed with a successful life and has no idea of the plight of other less fortunate. It is her right to explore the views of the landowners, but she is wrong for her unsympathetic comments about myself and the other tenants. The city of Alameda settled a lawsuit requireing affordable housing for low income. That tenament was a part of it until the houses went up and the city stood to profit off the taxes.I attended a meeting held by the city in 02/04 where they were discussing how to improve the area, I didn't know they had already been made aware of the Sanders brothers plans.
