JANICE ROGERS BROWN: HOW OUR INCOMPETENT BAY AREA "LIBERAL" MEDIA HELPED HER

by Alex Walker (AlexCathy [at] aol.com)
The US Senate voted 56 to 43 to confirm California Judge Janice Rogers Brown for a LIFETIME appointment on the DC Circuit Court. You'd never know from the shallow, incompetent coverage of Bay Area newspapers that several of her most dangerously crazy opinions were written about situations that happened right here.
The United States Senate voted 56 to 43 to confirm California Judge Janice Rogers Brown for a LIFETIME appointment on the DC Circuit Court. This morning, Jim Puzzanghera, The San Jose Mercury News' utterly clueless Washington Bureau hack, breathlessly begins with:

"Janice Rogers Brown -- the daughter of an Alabama sharecropper who put herself through college as a single mother and rose to become the first African-American woman on the California Supreme Court -- added another accomplishment to a remarkable life Wednesday..."

Puzzanghera goes on to write that there is already speculation about Brown being bumped to the United States Supreme Court.

Over the years I have been enraged many times about what Eric Alterman calls "The So-Called Liberal Media" but living right here in Northern California watching helplessly as this crazy person TO THE RIGHT of Clarence Thomas and Antonin Scalia floast to the top has been one for the books. Had I not been living right here in ultra-liberal San Francisco Bay watching the day to day incredibly incompetent coverage by the San Francisco Bay's So-called liberal media, I would not have believed it. For weeks and months we have only been told three things about this fascist:

(1) She's Black, the "first African-American woman" on the California State Supreme Court.

(2) She's an Alabama sharecropper's daughter, and

(3) She's against affirmative action, effectively framed almost exclusively as "racial preferences" for "unqualified" minorities.

Intel v Hamidi

Ken Hamidi, a nine-year engineer at Intel, the Silicon Valley based computer chip giant, was fired over a work injury dispute. Hamidi and his group, FACEINTEL, sent critical e-mail messages to Intel employees. Intel persuaded a state court to bar Hamidi from sending e-mail.

In July 2003 California's Supreme Court ruled that Intel failed to show any harm to its computer system or property interests. Justice Kathryn Mickle Werdegar, appointed by Republican Gov. Pete Wilson, wrote Hamidi "no more invaded Intel's property than does a protester holding a sign or shouting through a bullhorn outside corporate headquarters, posting a letter through the mail, or telephoning to complain of a corporate practice."

Janice Rogers Brown, however, claimed Intel has a "right not to listen."

Aguilar vs. Avis Rent A Car System

17 Latino workers at Avis's rental office at San Francisco International Airport were subjected for years to a barrage of racial epithets. The employees said they were routinely called "crooks," "wet----s," and "mother f--s." A San Francisco jury awarded damages and San Francisco Judge Carlos Bea issued an injunction against the racial slurs.

Janice Rogers Brown, however, claimed the court was censoring "disfavored ideas from the popular discourse."

Please note these cases have NOTHING TO DO with affirmative action. Please note these cases have NOTHING TO DO with religion.

Hi-Voltage Wire Works, Inc. vs. City of San Jose

This is the one affirmative action case the media and the politicians always talk about, but even in this case we have not been told all the facts about this local story. California Chief Justice Ronald George, appointed by Republican Gov. Pete Wilson, warned Brown's bizarre written concurring opinion "will be widely and correctly viewed as presenting an unfair, inaccurate caricature."

People v. Robert Young

In the middle of the Brown debate we learned of allegations the Alameda County D.A. kept Black women off juries in death penalty cases. Alas, nobody connected the dots between this outrage and Janice Rogers Brown's crazy claim there is no basis "black women might be the victims of a unique type of group discrimination."

Just for fun I looked up the figures.

In the 2004 election San Francisco cast 83.4% of its votes for Democrat John Kerry. Also, according to the 2000 census, 52.4% of the population of San Francisco is non-White.

In the 2004 election Santa Clara County, the heart of "Silicon Valley" cast 64% of its votes for Democrat John Kerry. Also, according to the 2000 census, 52.4% of the population of Santa Clara County is non-White.

No matter.

Even here the SO-CALLED LIBERAL MEDIA and clueless liberal Democrats are reliably incompetent when it comes to anything directly or indirectly related to substantive civil rights issues.

Thus, an event at the San Francisco Airport goes unreported by the San Francisco Chronicle; Hi-Voltage Wire Works, Inc. vs. City of San Jose goes unreported by the San Jose Mercury News; and the self-annointed "Newspaper of Silicon Valley" has forgotten about Ken Hamidi's heroic fight for Internet freedom.

We've been told more than we ever wanted to know about Scott Peterson and Michael Jackson. But the So-Called Liberal Media in its collective corporate wisdom has deemed that the only things we need to know about Janice Rogers Brown is that she is Black, a sharecroppers's daughter, and against affirmative action.

If Bush appoints this nut to the Supreme Court, we're toast.
