What: Steven Kubby Preliminary Hearing

Where: Placer Co. Jail; 2775 Richardson Dr.; Auburn, CA

When: Wednesday, February 15, 2006; 1 PM [press conference following hearing]

Why: In custody for 20 days, Steve Kubby, Prop
215 co-author and 1998 Libertarian CA
gubernatorial candidate suffers from adrenal
cancer. He is facing 120 days in jail,
revocation of probation and additional felony
charges for possession of one psilocybin mushroom
stem and three peyote buttons.

We would also like to clarify that Mr. Kubby and
his family did not flee to Canada, but where
given the court’s permission to travel there.
However, they did try to remain.

Placer County Jail does not have the medical
facilities or adequate resources to care for
terminally ill cancer patients and Steve is
suffering from new pains caused by his sciatica.
The Dr. has requested that Steve's orthotics be
returned to him. Items such as hip, knee, and
ankle supports would help him tremendously remain
in line and in less pain.

Michele says she has a small supply of Marinol
that has been donated, but she is not sure if the
Jail will allow them to be given to Steve since
they are not his prescription medicine. The
Placer County Sheriff has not said if they plan
to give Steve more Marinol when his runs out.
This would mean that Steve's body is going to go
into severe shock again and it could be very
deadly.

Please continue to call the Placer County Jail
requesting that Steve be given Marinol for his
condition.

Mr. Kubby has retained the services of cannabis
criminal defense attorney, J. David Nick to
further represent him in his case.

We believe that Placer County officials are
deliberately misleading the public and playing
Russian roulette with Mr. Kubby’s health. We
demand:

1. Allow Mr. Kubby to medicate with medical cannabis while in custody, and
2. Properly provide for his medical needs, or
3. Release Steve to house arrest where his
physical needs can properly be attended to, or
4. If Mr. Kubby should die in custody, we
demand that Placer County officials be held
accountable to the fullest extent of the law, as
well as face significant criminal and civil legal
penalties.

Hi! I would be interested if anyone could post here or e-mail me (crisericson [at] ispwest.com) with statistics on:
(1) what is the total number of persons who have died in city, town and county jails in California this year so far and in 2005?
(2) what is the total number of persons incarcerated with aids who died in a solitary confinement cell and were not moved to a hospice or medical facility?
(3) what is the total number of persons incarcerated with cancer who died in solitary confinement and were not moved to a hospice or medical facility?
(4) what motions have ever been filed by any attorney to remove a person out of solitary confinement who is actively dieing and within six months of death from aids or cancer . I want to bring to public attention the vast number of terminally ill people who are in solitary confinement, with rats, with sewage coming up in the hall in front of their solitary confinement cell allowing the rats to come up,
and remember, this is a pague in rainy season in low lying areas like Los Angeles,
(5) statistics on how many persons in solitary confinement cells are sprayed with pepper spray while they are inside the solitary confinement cell, locked in, and unable to harm anyone. this is a major problem, guards just going around spraying people in solitary confinement because they scream from rats.
etc.
It is long overdue to do a thorough investigation of conditions of ill persons in jails and prisons in California.
If Steve Kubby is to be the "poster boy" so to speak, for
the use of medical marijuana in jail,
let him also be the "poster boy" for abuse of all ill prisoners, particularly those kept in solitary confinement rather than being moved to hospices.
Didn't Steve Kubby say he had some blood in his urine the first days of confinement?
Doesn't that realistically mean he has only six months to live?
I hope all the info on today's hearing is posted soon.
