When are things going to burn? Reprimanding one policeman isn't going to stop what appears to be a steady rise in what is a PATTERN across this nation and the world (see Greece). If we take this sitting down and simply opt for a tacitly peaceful march then the numbers will keep mounting on who gets gunned down, who dies from a heartattack aftering being tazed and so forth. I am shocked by this video. I see no reason why either a gun or taser should have been drawn as the young men do not look like they were threatening or dangerous or had any weapons in their posession. If the BART PD wants to say it was chaotic down there I consider it of their own making since the young men could have been brought out of the station where bystanders would not be close by and then dealt with then, i.e. applying flex cuffs, checking pockets, asking questions etc. This is a complete lack of forethought; it's New Years, there will be fights no matter what way you look at it when so many people get together and are drinking and enjoying themselves. I could even see my own husband's friends getting in a scuffle on a train when it's that packed. Apparently guns were found earlier in the day and officials are saying BART PD was on edge; if these are trained law enforcement personnel they should be able to keep their compsure in situations such as this; my God, there were people all around! There is no excuse for this! There is an obvious difference between a taser and a gun: weight, size, etc. I am so pissed off that this happened. My thoughts go out to the family of this young man and his daughter. I would also file a lawsuit like the family is and seek criminal charges against the officer without a doubt. I hope they also try to change the policies of the BART PD in situations like this so it does not happen again to another family.

i am blown away by the whole story, this footage was much more clear and informative than others i've seen. besides the horrendous events of the fruitvale shooting i am thoroughly disgusted that $25 million settlement is the price they're asking for MURDER, by a cop, on an innocent man. is that really the cost of losing yr son, brother, nephew and father? it might as well be nothing at all.

A couple of comments re the previous posts . It might be a good idea to drive, car pool , or take a bus since the Fruitvale BART may be shut down. But if you do take BART don't be an idiot , PAY ! The station will be crawling with cops , uniformed and plainclothes . Don't set yourself up for a petty bust for fare evaison !
As re '' D'' comments that the shooting was probably an ''accident '' by a ''rookie'' who will be ''fucked for life''. Even if so he should still be tried for , at the very least, Manslaughter, and if convicted do many years in prison. Can you imagine if a ''civilian '' used the excuse , '' I meant to only taser him not shoot him . I feel terrible ! '' . Maybe , MAYBE , they would be spared the death penality .

Yes the cop did make a MAJOR mistake by pulling his gun instead of the taser and I do believe he should be tried for involuntary manslaughter...

He was resisting, maybe not to the extent to tase him but why resist at all? If you are caught in a bad situation and have done nothing wrong, then why not comply? If I get pulled over and arrested because someone who committed a crime is driving a car similar to mine, and is in the same area I was in, what other choice do cops have but eliminate you as a suspect? If I comply and they straighten out the facts, I get let go...

yes that is an inconvenience but if you resist, you are asking for trouble!! at the same time, what good does it do to block the station entrance and not allow people to go to work? all you protesters are doing is showing the world how ignorant you are... destroying property and looting?!?!

Look at the LA riots, yes the cops were wrong in what they did but the riots only caused pain and suffering to the very people involved in the riots to begin with... all stores destroyed, no food, having to stay at home because it wasn't safe to walk the streets and what good did all that do? nothing!!! It was a waste of money and what upset me the most, Rodney King didn't even straighten out his life! Arrest after arrest while all those suckers fought to get him justice!!

I'm pretty sure that we're not supposed to be living our lives according to the rules of COPS. A cop's job is hard, but its supposed to be hard. Why do you think when one of them is shot we give them parades? If a cop's job was easy we'd be living in a POLICE STATE. Even if this guy was acting three times as combative I'm not exactly sure a bullet to the back while being held down is justified action.

I'm not saying what he did was right but what I'm saying is society needs to accept when they are wrong.

yes what the cop did with the mix up is wrong and if he can make a mistake like that, he shouldn't be a cop. A cop needs to concentrate on what he's doing...

at the same time, if you did something wrong, man up and take it, you had the balls to do it, but not face the consequences? and not only that but why protest in the form of preventing people from going to work?

besides that cop quitting, he should face charges... a cop is a role model and if a cop commits a crime, to me they should get double the punishment because they should know better but based on how he reacted, you can tell he made a BIG mistake... just like the cop in LA who accidentally shot the military soldier who was handcuffed and doing what he was told.

Cops don't make laws ... their job is to enforce them.. so I'm not saying we should live our lives following the COPS LAW but the law of this country... I said for you all to educate your children to understand you can't just do wrong because you want to, everything has consequences...

The police are more concerned about protecting property, they could care less about what people are going through. Being a cop in Oakland must be a tough job, but maybe the city, county, and state should do something about oakland schools that are falling apart and maybe bring in some good jobs that allow for people to get out of poverty. Ooohh wait, that's right the state is billions of dollars in debt because our government and corporations are greedy, incompetent, and criminal. Forget helping the poor we need the money to go towards the military so they can wage endless wars...huh
No excuse for that cop, the evidence is plain and simple. If he doesn't get at least involuntary manslaughter for his gross negligence than there is something seriously wrong with the system.

Either way, the young man posed no immediate threat to any of the officers around him, therefore any kind of defensive action by the police officer was not necessary. Obviously YOU are not a lawyer. If you ever held a taser then a firearm you would know they feel nothing alike. The taser is wide and bulky made the way so they are not confused with each other.

I agree that it should be manslaughter and I agree with the rest of you that if he can't tell the difference, he shouldn't be in law enforcement... and it wasn't like he was just fresh out of the academy either but if you look at his reaction after he shoots, you can tell he was shocked and confused, he had no intent on shooting the man. In order for him to be charged with murder, there has to be an intent to kill or they would have to prove that he knew what he was doing and willingly shot is gun...

It's going to be hard to prove that in court. If anything he might just reach a plead agreement and send him to jail for a few years... and he shouldn't be sued for $25 million... not even the military soldier who got shot by an officer in Covina (or neighboring city) sued for that much and he's still alive and has to suffer with the injury for the rest of his life and was younger than this victim. It's not even realistic! If anything the Lawyer pursuing the lawsuit is crooked.

My understanding is the deranged murdering cop resigned the day after.
Either way, one would hope this would not be yet another policeman murdering
a young man and walking free.
I do not believe in the death penalty, however, there has to be a major deterrent so
that the police of this country stop killing, sodomizing, brutalizing, and pure hating
of the black male.
It must be in their training, or maybe they would prefer to belong to the KKK and find

If anyone other than a police officer had carried out a crime like that, they would be prosecuted to fullest extent of the law. How can you restrain a man, pull a gun out and shoot him in front of a great deal of people and then say it was involuntary manslaughter? The comments by Iria and others concerning MURDER v MANSLAUGHTER are ridiculous. It is clear that none of you are lawyers, studied law, or even watch good crime dramas on T.V. Premeditation and INTENT, while defined differently, both satisfy a MURDER 1 charge. Intent does NOT require planning, whether two days or two seconds. The pulling of his weapon is not necessarily intent. If he pulled it and it accidentally fired, or he was bumped or hit by lightning and it fired, or some other freak of nature caused it to fire, then maybe it wouldn't be MURDER 1. The pulling of the trigger IS INTENT. There is no trigger on a fucking taser. It feels completely different in your hand Do you think that we were all born yesterday? If it was sooo accidental, then why was there NO RUSH to get medical attention, no immediate calls for an ambulance, no tending to his wound, none of that shit? Just oops, I meant to taser him--yeah right! It's like your saying "Don't believe your lying eyes! You didn't really see what you saw!" Rodney King opened up the peoples' eyes on the use of technology to expose the ongoing brutality of some in law enforcement and we will NEVER GO BACK! I hope the people in Oakland, Ca really get the individuals involved in this and judging by Oakland history that will happen, but there is no excuse for this. I watched this a few times. The police officers were being rough and messed up as they always are. But watch towards the end. The problem here is that a gun should not have been introduced into the situation. The cop over reacted by pulling out his gun. The interesting thing is that the cop looks surprised when the gun discharges ( looking up and down then up). Plus his he never actual aims the gun. Its kind of to his side. Regardless with all of the media coverage, he will have to be prosecuted regardless. I am no fan of police officers! So as biased as I am against police officers this observation and commentary is out of the norm for me.

Everyone on that fucking subway should have fuckin' started a riot. Whether that cop shot him purposefully or not, he knew that could happen if he pulled out his gun. Or he should have. In all fairness he is a cop and they like to use fear [guns, spray, arrest threats] to get a recipient to calm down or comply.. so no forgiveness is granted here.

The officer should be presumed innocent until proven guilty. People are forming opinions about this case, only from video/mobil phone footage. We need to know the circumstances of the case and hear the officer tell us about his actions and intentions before deciding one way or the other.

In another video, it is incredibly clear that he drew back and stood up before firing, while the victim was laying on the ground face down. I don't know how it could possibly be said that the officer was attempting to tazer him instead as he was at a distance and aimed the gun directly at the victim.

It is crystal clear to me, after watching this video, that this was an execution; first degree intentional homicide committed by a vicious lying pig. The pig claimed in court that he "accidentally" shot Oscar Grant. However, the video clearly shows that as the pig felon stands after discharging his gun into the back of this handcuffed young man, he shows no surprise on his face. No bewilderment. No concern for the victim of the crime he just committed. No rush to get medical attention. No remorse. Judging by the expression on his face, he could just as well be standing up after checking the pressure in one of his car tires. If someone really and truly caused another person this sort of grievous injury accidentally, they would never have risen to their feet, as this lying piece of vermin did. Why didn't the other pigs, who were witnesses to this murder, arrest the murderer?

Now, a number of states have enacted laws that make it a crime to film these pieces of human refuse while they are in the act of committing crimes against the people they are supposed to be serving and protecting. Those laws would make it a criminal offense to record this murder, as, thankfully, someone did. If the Supreme Court does not strike down these so-called "wiretapping" laws, and soon, the U.S. will have crossed the line. It will be time for The People of the U.S. to rise up, and change the government in a most violent and forceful manner. All government. Local, state, and Federal. My ancestors did not come to this country and fight and die to overthrow a tyrant king just to let the country spiral into tyranny of the sort captured on this video. Oh? You say The State is not culpable in this? The State gave this pig 2 years in prison for the murder he committed. As I heard someone point out, Michael Vick got 4 years for killing a dog.

When I see video of the uprisings in the middle east, I ask myself "Why don't they just kill them?". The "they" are the downtrodden people living under those autocratic torturers and murderers, and the "them" are the tyrannical filth who have been stepping on the necks of their own people. When I watch the sort of video shown here, or any of a number of nauseating videos of violent psychopathic pigs harming U.S. citizens, the same question comes to mind.
